Lead-Free Legislation Now Effective
Lead-Free Legslation Now Effective January 1, 2010, laws in California (AB 1953) and Vermont (S152) mandate a significant reduction in the lead content of plumbing fixtures and fittings sold in these states. The new legislation: •Revises the definition of "lead-free" from 8 percent lead for pipes and pipe fittings and 4 percent lead for plumbing fittings and fixtures to “not more than a weighted average of 0.25% when used with respect to the wetted surfaces of pipes and pipe fittings, plumbing fittings, and fixtures.” •Prohibits a person from using these specified materials that are not lead free in the installation or repair of any public water system or any plumbing in a facility providing water for human consumption, except when necessary for the repair of leaded joints of cast iron pipes. •Prohibits a person from introducing into commerce, for use in California or Vermont, any specified material intended to convey or dispense water for human consumption that is not lead free. This includes kitchen faucets, lavatory faucets, and any other devices intended to convey or dispense water for human consumption through drinking or cooking. •Exempts plumbing fixtures and related devices that are used in manufacturing, industrial processing, for irrigation purposes, and any other uses where the water is not intended for human consumption. •Charters the Department of Toxic Substances Control to sample products from retail store and wholesale distribution shelves to verify lead free compliance (California only). California law also requires that all products be certified as compliant with AB 1953 through an independent, ANSI-approved third party. Starting January 1, 2010, products that do not meet the new lead-free standards cannot be sold in California and Vermont. Additionally, no person shall use any pipe, pipe or plumbing fitting or fixture, solder, or flux that is not lead-free in the installation or repair of any public water system or any plumbing in a facility providing water for human consumption, except when necessary for the repair of leaded joints of cast iron pipes. 4.Which products must meet the new lead-free standards in California and Vermont? The laws in California and Vermont apply to all plumbing products that convey or dispense potable water. According to the California Health and Safety Code, this includes “kitchen faucets, bathroom faucets, and any other end-use devices intended to convey or dispense water for human consumption through drinking or cooking.” 5.Does the law distinguish between residential and commercial applications? No, the law applies to both residential and commercial applications. 6.Which products are not affected by the lead-free legislation in California and Vermont? The law excludes products that are not part of plumbing systems that deliver water for human consumption. Examples of excluded products include tub and shower faucets, showerheads, electronic faucets, Roman tub faucets, toilets, urinals, flush valves, solenoid valves, hose bibbs, pre-rinse assemblies for commercial kitchen use that do not include an auxiliary spout or other outlet, service saddles, irrigation sprinklers, back-flow preventers for non-potable services such as irrigation and industrial, and water distribution main gate valves that are two inches in diameter and above. 7.How can I determine if a product meets the lead-free requirements of AB 1953? Per the legislation, all pipe, pipe or plumbing fixtures, solder, and flux must be certified by an independent American National Standards Institute (ANSI) accredited third party. All of the products in this catalog have received certifications and are compliant with the strict lead-free standards of California and Vermont. 8.How will AB 1953 be monitored for compliance? California’s Health and Safety Code Section 25214.4.3 requires the Department of Toxic Substances Control (DTSC) to acquire products for testing and evaluation. The DTSC will annually select up to 75 drinking water faucets and other drinking water plumbing fittings and fixtures for testing and evaluation to determine compliance with the lead content standards set forth in Health and Safety Code Section 116875.
